New USCIS fee schedule in force since 16 October 2026

Form G-1055 was reissued with the FY2027 fee set. What it means for a self-petitioned EB-1A, including the Asylum Program Fee line that most people read wrong.

USCIS reissued Form G-1055, the fee schedule, in an edition dated 16 October 2026, carrying the immigration-related fees for fiscal year 2027. It is in force now.

This is the kind of change that does not announce itself. Nothing about the process changes, no guidance is rewritten, and the number on the cheque is different.

What the current schedule says for an employment-based self-petition

Item Paper Online
Form I-140, immigrant petition US$ 715 US$ 665
Asylum Program Fee — self-petitioner US$ 300 US$ 300
Form I-485, adjustment of status (14+) US$ 1,440 US$ 1,390
Premium processing on the I-140 US$ 2,965 US$ 2,965

The line people read wrong

The Asylum Program Fee is an additional fee on the I-140, and the schedule sets three amounts:

  • regular petitioner — US$ 600
  • nonprofit — US$ 0
  • small employer or self-petitioner — US$ 300

A self-petitioner is in the third line, not exempt. If you have been told that filing an EB-1A or an NIW for yourself carries no Asylum Program Fee, that is wrong, and it is wrong by US$ 300 at filing.

What this means for a case in progress

Already filed: nothing changes. A package USCIS has received was accepted under the schedule in force on that date.

About to file: check the number against the schedule on the day you send it, not on the day you prepared it. What governs is the fee in force when USCIS receives the filing — and an incorrect fee is a rejection, which means the package comes back and the filing date is lost. That matters most when a priority date or a status expiry is close.

Still deciding: the government side of a self-petitioned EB-1A now starts at about US$ 965 filed online, and reaches roughly US$ 2,355 with adjustment of status. The full breakdown, with the attorney and preparation costs separated out, is in what an EB-1A actually costs.

Where to check

Form G-1055 is the schedule itself, and USCIS publishes a fee calculator alongside it. Both are linked in the sources below.

This page is a snapshot of 29 October 2026. Fees move, and the only number worth acting on is the one on the schedule the day you file.

Common questions

Questions people actually ask

Which fee applies — the one on the day I prepare, or the day I file?

What governs is the fee in force when USCIS receives the filing. A petition prepared under one schedule and filed after a change is adjudicated under the new one, and an incorrect fee is a rejection rather than a denial — the package comes back.

Does this change anything for a petition already pending?

No. A filing already received was accepted under the schedule in force on that date. What a fee change affects is what you file next, including a second petition or an adjustment application that has not gone in yet.

Where do I check the current number?

Form G-1055 is the authoritative schedule and USCIS also publishes a fee calculator. Any third-party page, including this one, is a snapshot of a day — confirm against the source before you send money.
